Mediation is an alternate process to resolve a dispute outside of Court. In many cases, Courts require parties in a civil matter to attempt mediation prior to final trial. The mediator works with the parties to reach a final resolution. If fully successful, a mediated settlement agreement is prepared and signed by the parties (and attorneys). The mediated settlement agreement is final and allows the parties to move on from their dispute.
At times, the parties are unable to reach a full agreement but are able to agree on part of the issues. In this case, a partial mediated settlement agreement is prepared and signed by the parties (and attorneys). The advantage of a partial mediated settlement agreement allows to narrow down the issues and shorten the length of a final trial.
